Post Brand new 2010 528I problems

I am new in this forum, so please be patient. If this is not the correct section of the forum, please let me know.

I am proud owner of few recent 750I and 335I models and I love them.. No serious problems yet except few transmission issues and broken engine belts, but nothing close to the problems having with my newest purchase..

Few weeks ago I picked up 528I for a family member.. Upon delivery and few days later, the dealer started to call and ask to bring the car back for "major" service and oil change. I checked online diagnostics and it showed that the card requires an oil change.

Dealer told me to add 1/2 quart of oil and it should go away and it did not.

Took the car to a totally different dealer and they stated that by resetting the computer, everything should be fine. The same evening they called and stated that there is a major problem with this car - apparently bunch of wires in the engine compartment were damaged by rodents and that I have to pay them $1,800 to get all the wires changed. I did not allow it to take place and took the vehicle back

The original dealer took the possession and has been holding on to it for over 2 weeks now. I had BMW North American involved, but they are not saying anything as of yet.

According to the service manager, they have to change the wires, but they can not guarantee that everything else is ok.. nor willing to do much of anything else.

When I purchased this car, it had only 35 miles and at the moment it has less than 500 miles. I did tell BMW North America to replace this car and give me brand new car as was intended and thus far, they are mute and are unwilling to talk.

Has anyone had this type of problem with their new cars and if so, what do you recommend?

To this forum admins - if this post is in the wrong section of the forum, please advise...

Well, looks like this one going to the courts after all...

BMW North American is pointing the finger at the dealer and the dealer is pointing the finger at BMW North America and nobody wants to address the issue.

None of them wants to be responsible for this troubled car.

Pre-inspection would have found these problems and the dealer did not perform such a task. Rather, they went by yet another dealer pre-inspection, who delivered car to them that we leased this car from.

Having several BMW vehicles both in lease and ones I purchased before, they lost a good customer. Once this ends up in the courts (actually our process starts this upcoming Monday), the all the gloves are off.

Rodent infestation is a real problem and thanks for many other posts that are related to this issue in this forum. Just the fact that you purchase or lease a brand new BMW that comes to you with such an infection should not be taken easy. I expected BMW North American to step up to the plate and do the right thing. Instead, they are saying that they can fix anything, even wiring that were chewed by rodents, but will not take responsibility on anything else nor willing to identify anything else. Basically they are saying that I am on my own and either take it or leave it.

Has anyone battled against them and if so, how was your experience? This was not in my agenda when this car was delivered. Both the dealer and the BMW North America are playing a very dangerous game in minimizing the premier name like BMW nor they care to perform for the customer...

BMW, what happened to you and your good name?
